Fosen Vind: Update on the judgment of the Supreme Court in Norway of 11 October 2021

We fully understand the frustration over the lack of a conclusion to the case. The Norwegian Ministry of Petroleum and Energy (MPE) has described the process it will follow in light of the Supreme Court’s ruling to determine how the cultural rights of Sami communities can be adequately respected and protected in resolving this issue. The MPE process envisages that the next steps will be developed through consultation and engagement with the affected Sami communities and their representatives, as well as the other parties involved.

Energy Infrastructure Partners (EIP) is fully committed, through the relevant bodies, to finding and implementing sustainable solutions that fully respect the rights of Sami communities in accordance with all applicable requirements.

At the request of the Minister of Petroleum and Energy, a mediation process was launched on May 15, 2023, to accelerate the search for a solution. The mediation team consists of neutral mediator Mats Ruland, Sami reindeer husbandry expert Tom Kristian Lifjell and District Court Judge Hanne Sofie Bjelland.

EIP is in close and active exchange with Fosen Vind DA and Roan Vind DA, which operate the wind farms, and is closely following the mediation process. In addition to maintaining a close dialogue with the affected parties and offering temporary support and compensation measures, Fosen Vind DA and Roan Vind DA are actively participating in the mediation process.

Fosen Vind DA and Roan Vind DA have participated in all meetings organized this year. The mediation process is still ongoing and we hope that it will lead to a good solution for all parties involved.
